ADRIATIC TRAVEL DESIGN (ATD)
General Terms and Conditions for Providing Accommodation Services
Please read the following terms because when booking, the customer confirms that he is familiar with the General Terms and that he accepts them in their entirety. Thus, everything stated in the General Terms and Conditions becomes legally binding both for the customer and for Adriatic Travel Design as the mediator providing accommodation services.
General Terms of Business
These General Terms of Business are legally binding for all activities undertaken by our system.
For your easier reference the terms are divided according to standard proceedings and general provisions describing mutual relations of the participants in the process of sale:
Inquiries and booking
Travel Design will proceed all inquiries and booking of accommodation to a requested facility or the specific provider of the accommodation services. Travel Design will provide the answer to all requested information directly or in agreement with the ultimate provider of services.
Guest, agreement, booking and payment
When booking, the customer is required to give all the information necessary in the booking procedure. When booking, the customer is required to pay the first instalment pursuant to the terms referred to in the Confirmation of Booking. If the customer doesn”t meet the obligation of the payment of the first instalment pursuant to the terms referred to in the Confirmation of Booking, the provisions of the General Terms of Business cease to exist. More or less it means cancelling of all booked services with no further obligations for either party participating in the process of sale.
Confirmation of Booking
ATD and providers of accommodation services explicitly state that the Confirmation of Booking issued by the ATD system, along with enclosed receipts on paid booking amounts is regarded as a document- voucher giving the right to consume the booked services .In case of any dispute the mentioned documents have the power of the Agreement signed by us and respecting the hereby defined conditions.
Customer”s right to changes and cancellation
Should the customer wish to change or cancel a reservation the conditions for the cancellation of reservation listed below will be enforced:
- All requests to change or cancel a reservation are done via our company”s contact addresses along with the obligatory acknowledgement receipt issued by our company.
- The first change to the reservation and in case of justified cancellation claims our company, that is the providers of accommodation services, may accept these changes or cancellation free of charge. For all further changes to the reservation 10 EUR will be charged per change.
- In cases of unjustified changes to a reservation or cancellation, money paid up to that moment will be retained depending on the remaining number of days before the booked services are put to use, namely:
- for cancellation up to 30 days before - 20% of the package price will be charged, a minimum of 25 €
- from 30 - 10 days - 50% of price
- from 10 - 1 days - 80% of price
- should the customer not come - 100% of price will be charged
ATD”s right to changes and cancellation
Adriatic Travel Design reserves the right to change or modify a reservation in case of circumstances caused by conditions beyond its control that cannot be predicted, avoided or rectified (wars, riots, strikes, acts of terrorism, natural disasters, sanitary disruptions, restrictions by local authorities, death or illness of service provider and the like).
Booked accommodation can be substituted only by an accommodation unit of the same category and at the price confirmed during booking, and should the price of the substitute accommodation be higher by 5% or more than the initially booked accommodation, ATD reserves the right to charge the price difference upon consulting the customer. The guest retains the right to refuse the offered accommodation. In cases where substitute accommodation for paid accommodation is not available or the guest refuses to accept it ATD reserves the right to cancel the reservation at least 7 days before arrival and guarantees the refund of the amount paid up to then. If the ATD fails to cancel the reservation in due time the guest is entitled to a refund of the complete paid amount and the additional indemnity up to 30% of the total paid amount.
Other provisions
Categorization and service description
Accommodation units offered by ATD are described in accordance to the official categorization of the authorized institution, and based on onsite assessment prior to being put in ATD”s online offer.
Prices and services
The price of accommodation includes seasonal or daily prices and are valid for defined services and all bookings done using our system.
Sojourn tax
The amount of Sojourn Tax will not be stated on the calculation and the guest is required to pay the amount upon arrival. According to the Croatian Law on the Sojourn Tax, customers are required to pay the Sojourn Tax when paying for their accommodation. The Sojourn Tax in the Republic of Croatia varies from 2,00 to 7,00 KN per person per day for adults.
Customers from the age of 12 to 18 have a 50% discount, while children under the age of 12 are exempt from paying. The final amount of the Sojourn Tax is determined by the destination in the Republic of Croatia and travel period, and is charged according to the General Terms and Conditions when balance payment is made.
Complaints
Should the services provided not be satisfactory, the customer is entitled to seek reasonable compensation by filing a written complaint to the person in charge ( director or reception desk manager) along with the receipt of complaint acknowledgement. The guest is required to complain to the service provider about the inadequate accommodation service within 48 hours after the arrival at the accommodation unit to a person in charge of a facility and Adriatic Travel Design”s emergency service at the e-mail address info@travel-design.com or telephone number +385(0)52 617 770.
Adriatic Travel Design will provide for all other requirements including carrying out of services and meeting guest”s rights and interests.
In dealing with the complaints the tourist business terms and conditions will be implemented.
Customer”s obligations
The customer is required:
- to have valid travel documents(identity documents)
- to obey regulations of the country where the destination is located
- to obey house rules in accommodation units and to have good relations with the host
- to produce the confirmation of payment for booked services (Receipt of booking and payment) upon arrival
Other
We cannot completely guarantee for possible unintentional data mistakes or data transfer mistakes. We believe that the eventual incompleteness of some data will not affect the entirety of our relations. In that case we assume the obligation of guests” indemnity in accordance with the provisions of the General Terms of Business.
Court jurisdiction
Should the customer not be satisfied with the solution to the complaint, the matter can be taken to court.
Data protection
All the information regarding booking and accessed by the ATD through the system or in any other way on the part of the ATD will be treated as a business secret.
